need special educational services [and for each individual who
qualifies for compensatory special educational services], whether
or not the child is receiving nonduplicative services from
another governmental agency.
8-406.
(a). After the standards required in § 8-403 of this
subtitle are adopted, the State Superintendent shall develop a
plan to provide special educational services [and compensatory
special educational services] for children UNDER THE AGE OF 21
who are in State institutions.
8-409.
(c) (3) The State Board shall adopt bylaws that establish
standards and guidelines for approvals required by PARAGRAPH (2)
of this subsection.
8-414.
(f) (2) If the State Superintendent finds that the child is
not eligible for the appointment of a parent surrogate in
accordance with [subsections] SUBSECTION (b) or (c) of this
section, the Superintendent shall notify the requesting public
agency of this finding and specify the reasons in writing.
11-202.
Notwithstanding any other provision of law to the contrary,
the governing boards of the public institutions of higher
education may transfer any personnel position from 1 program to
any other program under such governing board's jurisdiction
without the approval of any other officer, board, department, or
agency of the State, provided that the total number of positions
[at] FOR all of the programs under the governing board's
jurisdiction does not exceed the total number of authorized
positions for all the programs under the board's jurisdiction as
provided in the annual budget bill or its supporting documents.

(e) Subject to the authority of the commissioner of higher
education, the Commission shall:
