(j) The provisions of this section shall become effective
either:
(1) [when] WHEN funds are appropriated by the General
Assembly or otherwise become available to defray the initial
costs in establishing the pool authorized by this section; or
(2) At a time designated by the fiscal agent provided
for in subsection (h) of this section.

(d) To the extent that funds are available in the budget,
the Treasurer shall provide self-insurance or purchased insurance
or a combination of self-insurance and purchased insurance
sufficient to cover the liability of the State and its employees
under [Subtitle 4 of Title 5 of the Courts] TITLE 12, SUBTITLE 1
OF THE STATE GOVERNMENT Article of this Code.

(f) A determination under [subsections] SUBSECTION (d) or
SUBSECTION (e) of this section to recoup benefits may not be made
later than 3 years from the date that the benefits were paid to
the claimant. Any amount which has not been recouped with 5
years of the date of the determination may be deemed
uncollectible at the judgment of the Executive Director.

(c) Each employer shall pay contributions with respect to
employment during any fiscal year prior to July 1, 1964, as
required by this article prior to July 1, 1964, and each employer
shall pay contributions at the standard rate of 2.7 percent of
wages paid by the employer during the fiscal year beginning July
1, 1964, and during each fiscal year thereafter with respect to
employment occurring after June 30, 1964, through June 30, 1984,
except as otherwise provided in this article. For the fiscal
year beginning July 1, 1984, and during each fiscal year
thereafter, each employer shall pay contributions at the standard
rate of 5.4 percent of wages paid by the employer with respect to
employment occurring after June 30, 1984, except as otherwise
provided in this article.
(4) The Executive Director shall determine for each
fiscal year the contribution rate of each employer who has met
the requirements specified in subsection (c)(3) of this section,
