14-1013. ASSAULTING A COLLECTOR.

A PERSON WHO ASSAULTS A COLLECTOR WHO IS PERFORMING A DUTY
IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE
NOT EXCEEDING $500 OR IMPRISONMENT NOT EXCEEDING 12 MONTHS OR
BOTH.

REVISOR'S NOTE: This section is new language that repeats
the provisions of present Art. 81, § 126, as that
section relates to the prohibition and penalties for
assaulting a collector.

The reference to a "misdemeanor" is added for
conformity.

The present word "strike" is omitted as unnecessary in
light of the use of the word "assault".

The present provision relating to assaulting "any
person serving as one of the posse comitatus" is
omitted as obsolete.

The present word "indictment" is omitted as
superfluous.

The present minimum penalties are omitted to conform
to the statement of legislative policy contained in
Art. 27, § 643 of the Code, which sets forth the
general rule that, notwithstanding a prescribed
minimum penalty, the court nevertheless may impose a
lesser penalty of the same character.

A PERSON WHO ASSAULTS ANOTHER PERSON TO STOP THAT PERSON
FROM BIDDING AT A COLLECTOR'S SALE OR BECAUSE THAT PERSON BID AT
A COLLECTOR'S SALE IS GUILTY OF A MISDEMEANOR AND ON CONVICTION
IS SUBJECT TO A FINE NOT EXCEEDING $500 OR IMPRISONMENT NOT
EXCEEDING 12 MONTHS OR BOTH.
