Re: House Bill 949
Dear Governor Hughes:
We have reviewed and hereby approve for constitutionality
and legal sufficiency House Bill 949 which requires the Veterans
Commission to provide without charge grave liners for the plots
in its cemeteries. The bill limits the cost to $55.
As the enclosed letter from Assistant Attorney General Linda
Lamone to F. Carvel Payne indicates, there is a question of
whether the conference committee report which was adopted by the
respective Houses adds an inflation factor to the limitation on
cost. While the report is subject to interpretation, we continue
to think that the Legislature adequately manifested an intent
that this bill include an inflation factor. However, there is no
legal objection to signing the bill as it has been printed.

Dear Mr. Payne:
This is in response to your request for advice of counsel
concerning House Bill 949. Specifically, you have asked (1)
whether the bill should be printed and presented to the Governor
for his consideration and (2) if so, in what forms should the
bill be printed. For the following reasons, it is my view that
the bill may be printed and presented to the Governor in the
manner described below.
The journal entries of the House of Delegates and the Senate
show the following:
1. The bill was introduced on January 31, 1985. It passed
the House on third reading on March 22, 1985, and was referred by
the President to the Senate Finance Committee on the same day.
