(iii) Adjust, in accordance with market
conditions, the prices of goods and services offered for sale to
the State by eligible sheltered workshops; and

(iv) At the request of a sheltered workshop,
review or change the price of a good or service.

(2) The pricing and selection committee for sheltered
workshops is composed of 5 members, as follows:

(i) 2 members of the Maryland Association of
Workshops, Inc.;

(ii) The Secretary of General Services, or his
designee;

(iii) The Secretary of Public Safety and
Correctional Services, or his designee; and

(iv) The Executive Vice President of Blind
Industries of Maryland or his designee.

(d) (1) If suitable supplies or services are available for
procurement from any department or agency of the State, and
procurement therefrom is required by the provisions of any other
section of this article or of any other law of this State,
procurement of the supplies shall be made in accordance with the
other provisions of law.

(2) If suitable supplies or services are not
available for procurement from any department or agency of the
State under the provisions of paragraph (1) of this subsection,
the pricing and selection committee shall determine whether the
supplies or services are available for procurement from an
eligible sheltered workshop.

Article 100 - Work, Labor and Employment

85.

(b) (1) The Commissioner may determine rates less than the
fixed minimum wage for those handicapped by physical or mental
disability upon the circumstances of the individual case and
shall issue certificates for such periods of time as stated
therein.

(2) In lieu of the issuance of certificates, the
Commissioner shall accept a "sheltered workshop certificate" or a
"work activities certificate" issued by the U. S. Department of
Labor if it is filed with the Commissioner within ten days after
receipt of certification by the certificate holder. However, the
acceptance of a "sheltered workshop certificate" or a "work
activities certificate" does not apply automatically to
individuals who have continued to work in a "sheltered workshop"
