this article or any other law requires the imprisonment to be
served at any one of those institutions enumerated in § 689 of
this article, shall in all such cases sentence such persons to
the jurisdiction of the Division of Correction. All such persons
shall be committed to the custody of the Commissioner of
Correction and delivered to him for imprisonment. Thereafter all
such persons shall be held, confined in, assigned to or
transferred to such of the institutions and facilities under the
jurisdiction of the Division as the Division from time to time
may order, including State Police barracks where such use is
convenient and practical.
Any person sentenced prior to June 1, 1967 to any one of the
institutions and facilities under the jurisdiction of the
Division may, after such date, and notwithstanding such sentence,
be held, confined in, assigned to or transferred to such of these
institutions and facilities as the Division may from time to time
order.
(c) No sentence by any judge to the jurisdiction of the
Division may be for less than [three months] 6 MONTHS, any
provisions of this article or any other law to the contrary
notwithstanding.
(C) (1) NOTWITHSTANDING ANY PROVISIONS OF THIS ARTICLE OR
ANY OTHER LAW TO THE CONTRARY, A SENTENCE BY ANY JUDGE TO THE
JURISDICTION OF THE DIVISION SHALL COMPLY WITH THE FOLLOWING
STIPULATIONS:
(I) AS OF JULY 1, 1985, NO SENTENCE SHALL BE
FOR LESS THAN 6 MONTHS;
(II) AS OF JULY 1, 1986, NO SENTENCE SHALL BE 6
MONTHS OR LESS;
(III) AS OF JULY 1, 1987, NO SENTENCE SHALL BE
FOR LESS THAN 12 MONTHS;
(IV) AS OF JULY 1, 1988, NO SENTENCE SHALL BE
12 MONTHS OR LESS.
(2) FOR PRISONERS SENTENCED ON OR AFTER JULY 1, 1986,
THE STATE SHALL REIMBURSE THE COUNTIES AND BALTIMORE CITY FOR
EACH DAY IN EXCESS OF 90 DAYS THROUGH DAY 365 THAT PRISONERS WITH
SENTENCES OF MORE THAN 3 MONTHS TO NOT MORE THAN 18 MONTHS ARE
CONFINED IN A LOCAL DETENTION CENTER. THE RATE OF REIMBURSEMENT
SHALL BE 50 PERCENT OF THE RATE AS SET FORTH IN SUBSECTION (G) OF
THIS SECTION.
(3) (I) IN THIS SUBPARAGRAPH THE TERM "AVERAGE NUMBER
OF PRISONER DAYS" MEANS THE AVERAGE ANNUAL NUMBER OF DAYS SERVED
BY PRISONERS DURING 1983, 1984, AND 1985 FISCAL YEARS WHO ARE
SENTENCED FOR MORE THAN 3 MONTHS AND 12 MONTHS OR LESS AND THE
