Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 312.
This legislation would require that the two employee members
of the Board of Trustees of the Deferred Compensation Plan must
be classified employees of the State of Maryland.
Senate Bill 812, which I have signed today, abolishes the
Board of Trustees of the Deferred Compensation Plan and replaces
it with the Board of Trustees of the Maryland Teachers and State
Employees Supplemental Retirement Plans. The new Board of
Trustees will act as a single governing body for all of the State
supplemental compensation plans. The composition of this new
Board consists, in part, of three members eligible to participate
in at least one of the retirement plans. However, at least one
of these three members must be a teacher.
Notwithstanding my disapproval today of Senate Bill 312, as
part of the initial appointments to the new Board of Trustees of
the Maryland Teachers and State Employees Supplemental Retirement
Plans, I intend to appoint at least one classified employee to
the Board.
Therefore, for the above reasons, I have decided to veto
Senate Bill 312.

FOR the purpose of requiring that classified State employees be
appointed by the Governor as the employee members of the
board of trustees of the Maryland State Employees Deferred
Compensation Plan.
