(A) IF THE SUPERINTENDENT FINDS THAT A COUNTY IS NOT
COMPLYING WITH THE MAINTENANCE OF EFFORT PROVISIONS OF § 36 OF
THIS ARTICLE, THE SUPERINTENDENT SHALL NOTIFY THE SUBDIVISION OR
QUALIFYING MUNICIPALITY OF SUCH NONCOMPLIANCE.
(B) IF A SUBDIVISION OR QUALIFYING MUNICIPALITY DISPUTES
THE FINDING WITHIN 30 DAYS OF THE ISSUANCE OF SUCH NOTICE, THE
DISPUTE SHALL BE PROMPTLY REFERRED TO THE SECRETARY OF THE
DEPARTMENT OF BUDGET AND FISCAL PLANNING WHO SHALL MAKE A FINAL
DETERMINATION.
(C) UPON RECEIPT OF CERTIFICATION OF NONCOMPLIANCE BY THE
SUPERINTENDENT OR THE SECRETARY OF THE DEPARTMENT OF BUDGET AND
FISCAL PLANNING, AS THE CASE MAY BE, THE COMPTROLLER SHALL
SUSPEND, UNTIL NOTIFICATION OF COMPLIANCE IS RECEIVED, PAYMENT OF
ANY FUNDS DUE THE SUBDIVISION OR QUALIFYING MUNICIPALITY FOR THE
CURRENT FISCAL YEAR, AS PROVIDED IN § 37 OF THIS ARTICLE, TO THE
EXTENT THAT THE STATE'S AID DUE THE SUBDIVISION OR QUALIFYING
MUNICIPALITY IN THE CURRENT FISCAL YEAR, UNDER THAT SECTION
EXCEEDS THE AMOUNT WHICH THE SUBDIVISION OR QUALIFYING
MUNICIPALITY RECEIVED IN THE PRIOR FISCAL YEAR.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.

Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 271.
Senate Bill 271 would increase the annual salary of the
Baltimore County Board of License Commissioners. The bill would
take effect July 1, 1985.
Article III, Section 35 of the Maryland Constitution
prohibits the salary or compensation of any public officer to be
increased or diminished during the officer's term of office
unless the officer is serving a term exceeding 4 years. The
members of the Baltimore County Board of License Commissioners
are appointed by the County Executive biennially for a term
beginning the first Monday in June, e.g., June 3, 1985.
Therefore, I have been advised by the Attorney General that the
salary increase authorized in Senate Bill 271 may not
