Tidal Fish License - Nonresident Buyers and
Sellers of Fish

FOR the purpose of providing for a certain license fee for a
person to buy certain live fish for export from the State
under a Tidal Fish License; requiring the Department of
Natural Resources to waive certain annual tidal fish license
fees for certain nonresidents who buy fish in Maryland but
do not sell the fish in Maryland; and clarifying that the
surcharge for nonresident fishing activities applies only to
activities that directly relate to harvesting fish and not
to certain other activities; limiting the scope of certain
waivers of tidal fish licenses to State residents;
prohibiting the transfer or loan of a certain tidal fish
license subject to certain exceptions; permitting a licensee
to transfer a certain tidal fish license under certain
circumstances; and generally relating to tidal fish
licenses.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Natural Resources

4-701.

(a)  This section applies to any person who is required
under Subtitles 2, 7, 8, 9, or 10 of this title to be licensed to
guide fishing parties or to catch, sell, buy, process, transport,
export, or otherwise deal in fish caught in tidal waters.

(b)  The Department shall utilize a single license, called a
tidal fish license. A tidal fish license shall authorize the
licensee to engage in each activity indicated on the license.

(c)  The license year for every tidal fish license shall be
from September 1 through August 31 of the following year. In any
license year, a person will be licensed to engage in only those
activities for which the annual fees for that year have been
paid.
