LAWS OF MARYLAND

Ch. 756

(1) DIMINISH ANY AUTHORITY OF A MUNICIPAL CORPORATION
TO LICENSE AND REGULATE MOBILE SEAFOOD VENDORS; OR

(2) APPLY TO CHARITABLE OR NONPROFIT VENDORS WHO SELL
SEAFOOD AT SHORT-TERM FESTIVALS OR OTHER SHORT-TERM EVENTS.

24-303.

(A)  WHEN LOCATED ON THE RIGHT-OF-WAY OF ANY STATE HIGHWAY,
A MOBILE SEAFOOD VENDOR MAY NOT SELL, OR OFFER FOR SALE, ANY
SEAFOOD, UNLESS THE MOBILE SEAFOOD VENDOR HAS A LEASE FROM THE
STATE THAT PERMITS THE MOBILE SEAFOOD VENDOR TO SELL OR OFFER FOR
SALE SEAFOOD.

(B)  A MOBILE SEAFOOD VENDOR MAY NOT SELL, OR OFFER FOR
SALE, ANY SEAFOOD, WHEN LOCATED:

(1) WITHIN 100 YARDS OF AN INTERSECTION OF ANY 2
HIGHWAYS OF ANY TYPE;

(2) WITHIN 50 YARDS OF ANY VEHICULAR ENTRANCE TO OR
EXIT FROM A SCHOOL OR PLACE OF WORSHIP, UNLESS THE MOBILE SEAFOOD
DEALER HAS WRITTEN PERMISSION OF THE APPLICABLE SCHOOL BOARD OR
PERSON WHO IS RESPONSIBLE FOR THE BUILDINGS AND GROUNDS OF THE
PLACE OF WORSHIP;

(3) (2) WITHIN 100 YARDS OF ANY VEHICULAR ENTRANCE TO
OR EXIT FROM ANY SHOPPING CENTER;

(4) (3) IN THE PARKING LOT OF ANY SHOPPING CENTER,
UNLESS THE MOBILE SEAFOOD VENDOR HAS WRITTEN PERMISSION OF THE
OWNER OF THE SHOPPING CENTER AND CONFORMS TO APPLICABLE LOCAL
LAWS AND ORDINANCES;

(5) (4) LESS THAN 15 YARDS WITHIN A SAFE AN UNSAFE
DISTANCE, AS DETERMINED BY THE LOCAL AUTHORITIES, FROM THE EDGE
OF ANY ROADWAY;

(6) (5) ON ANY ROADWAY; OR

(7) (6) EXCEPT AS PERMITTED UNDER § 24-303 OF THIS
SUBTITLE, ON PRIVATELY OWNED PROPERTY ADJOINING A STATE HIGHWAY,
UNLESS THE MOBILE SEAFOOD VENDOR OWNS, LEASES, OR HAS WRITTEN
PERMISSION OF THE OWNER OF THE PRIVATELY OWNED PROPERTY.

IF A MOBILE SEAFOOD VENDOR KEEPS ON THE VENDOR'S PERSON, AT
ALL TIMES, THE WRITTEN PERMISSION OF THE OWNER OF THE PROPERTY,
SIGNED BY THE OWNER OF THE PROPERTY, THE MOBILE SEAFOOD VENDOR
MAY SELL, OR OFFER FOR SALE, SEAFOOD, WHEN LOCATED ON PRIVATELY
OWNED PROPERTY ADJOINING A STATE HIGHWAY.
