providing a certain procedure to make the determination;
providing that the Office on Aging may require a provider to
submit a financial plan under certain conditions; providing
the conditions under which the Office on Aging may withdraw
or refuse to review renew a certificate of registration;
requiring providers to submit cash operating budgets for
certain fiscal years when applying for renewal of a
certificate of registration; defining certain terms; and
generally relating to continuing care communities.

SECTION 1. BE IT ENACTED BY THE GENERAL 'ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 70B - Office on Aging

(J) "CERTIFIED FINANCIAL STATEMENT" MEANS A COMPLETE AUDIT
PREPARED AND CERTIFIED TO BY AN INDEPENDENT CERTIFIED PUBLIC
ACCOUNTANT.

(a) No provider shall enter into or renew a contract for
continuing care in this State without [a] THE APPROPRIATE
certificate of registration issued by the Office.

[11.] 10.

(a) All providers licensed under this article or the Health
- General Article who intend to offer continuing care agreements
and who have not acquired the necessary facilities for providing
continuing care by the effective date of the rules shall file
with the Office on Aging a statement of intent to provide
continuing care and shall provide the same information as
required under § [10] 11 for application of a certificate of
registration.
