(i) The retirement allowance payments shall
terminate after the last day of the month preceding the date of
return to active service and the individual shall become a member
of the Pension System for Teachers of the State of Maryland, or
the Pension System for Employees of the State of Maryland as
applicable to the position.
(ii) All previous creditable services shall be
restored to the account of the member.
(iii) The member shall be credited with service
performed from the date of reemployment to the date of the
member's later retirement.
(iv) Upon later retirement or death on active
service, the member's reserves shall be reduced by the total
amount of payments made to the member during his or her earlier
retirement, unless the system is reimbursed for such payments by
the member.
(C) THE PROVISIONS OF PARAGRAPH (B) OF THIS
SUBSECTION DO NOT APPLY TO:
(I) AN ELECTED OFFICIAL OF A COUNTY OR A
PARTICIPATING MUNICIPAL CORPORATION WHO SERVES IN AN OFFICIAL
CAPACITY ON A FULL-TIME BASIS OR PART-TIME BASIS; AND
(II) AN APPOINTED OFFICIAL WHO SERVES IN AN
OFFICIAL CAPACITY ON A PART-TIME BASIS.
(II) AN OFFICIAL WHO:
1. IS APPOINTED TO FILL A VACANCY OF AN
ELECTED OFFICE OF A COUNTY OR A PARTICIPATING MUNICIPAL
CORPORATION; AND
2. SERVICES IN AN OFFICIAL CAPACITY ON A
FULL-TIME BASIS OR PART-TIME BASIS.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the provisions of Article 73B, Sections ll(15)(b),
86(9)(b), 117(14)(b), and 145(13)(b) of the Code do not apply to:
(1) An elected official of a county or a participating
municipal corporation who is serving in an official capacity on a
full-time basis or part-time basis on June 30, 1985; and
(2) An official who:
(a) Was appointed to fill a vacancy of an elected
office of a county or participating municipal corporation; and
(b) Is serving in an official capacity on a full-time
basis or part-time basis on June 30, 1985.
