CHAPTER 746

(House Bill 143)

AN ACT concerning

Pensions - Transfer of Eligibility Service

FOR the purpose of providing for the transfer of eligibility
service of former members of the pension systems for
employees and teachers under certain circumstances;
providing for the effect of these transfers; and providing
for the application of this Act to transfers from a certain
date.

BY adding to

Article 73B - Pensions

Section 114(6) and 143(6)

Annotated Code of Maryland

(1983 Replacement Volume and 1984 Supplement)

BY repealing and reenacting, with amendments,

Article 73B - Pensions

Section 115(7) and 144(7)

Annotated Code of Maryland

(1983 Replacement Volume and 1984 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 73B - Pensions

114.

(6) (A) IF A FORMER MEMBER OF THE PENSION SYSTEM FOR
TEACHERS WHO IS NOT RETIRED IS RESTORED TO SERVICE WITHOUT HAVING
INCURRED A BREAK IN SERVICE AND IS REQUIRED TO BE A MEMBER OF
THIS PENSION SYSTEM FOR EMPLOYEES, THE ELIGIBILITY SERVICE TO
WHICH THE FORMER MEMBER WAS ENTITLED UNDER THE PENSION SYSTEM FOR
TEACHERS SHALL BE CREDITED TO THE FORMER MEMBER IN THIS PENSION
SYSTEM.

(B) (I) SUBJECT TO ITEM (II) OF THIS PARAGRAPH, IF A
FORMER MEMBER OF THE PENSION SYSTEM FOR TEACHERS WHO IS NOT
RETIRED HAS INCURRED A BREAK IN SERVICE AND IS RESTORED TO
SERVICE REQUIRING MEMBERSHIP IN THIS PENSION SYSTEM FOR
EMPLOYEES, THE ELIGIBILITY SERVICE TO WHICH THE FORMER MEMBER WAS
ENTITLED UNDER THE PENSION SYSTEM FOR TEACHERS SHALL BE CREDITED
TO THE FORMER MEMBER IN THIS PENSION SYSTEM.
