(5)] Any position that is created or redesignated as
a permanent position and assigned to the clerk of the Circuit
Court for Baltimore City after January 1, 1983.
Article 41 - Governor - Executive and Administrative
Departments
17A 117A.
(a) There is hereby created a Division of Parole and
Probation, which shall be part of the Department of Public Safety
and Correctional Services, and the head of which shall be the
Director of Parole and Probation. The director shall be appointed
by the Secretary of Public Safety and Correctional Services, with
the approval of the Governor of Maryland and by and with the
advice and consent of the Senate of Maryland for an indefinite
term, at the pleasure of the Secretary. The salary of the
director shall be as provided in the annual State budget.
(b) Subject to the authority of the Secretary of Public
Safety and Correctional Services, the Division of Parole and
Probation shall have the following duties, in addition to any
other duties provided for herein or by law:
[1.] (1) To supervise the conduct of parolees, and to
regularly inform the Commission of their activities.
[2.] (2) To recommend, in the discretion of the
Division, that the Commission issue warrants for the retaking of
parolees.
[3.] (3) To issue warrants, upon the delegation of
this power to the director of the Division, for the retaking of
parolees charged with a violation of parole.
(4) TO PERFORM, IN BALTIMORE CITY, ALL DUTIES AND
FUNCTIONS RELATED TO PRE-TRIAL RELEASE, FORMERLY PERFORMED BY THE
PRE-TRIAL RELEASE SERVICES DIVISION OF THE OFFICE OF THE CLERK OF
THE CIRCUIT COURT FOR BALTIMORE CITY.
(C) (1) THE PRE-TRIAL RELEASE SERVICES DIVISION OF THE
CIRCUIT COURT FOR BALTIMORE CITY IS AN OPERATIONAL UNIT OF THE
DIVISION OF PAROLE AND PROBATION.
(2) THERE IS A PRE-TRIAL RELEASE COMMITTEE IN THE
DIVISION OF PAROLE AND PROBATION.
(3) THE PRE-TRIAL RELEASE COMMITTEE CONSISTS OF:
(I) THE DIRECTOR OF THE DIVISION OF PAROLE AND
PROBATION OR THE DIRECTOR'S DESIGNEE; AND
(II) 2 JUDGES TO BE APPOINTED BY THE
ADMINISTRATIVE JUDGE OF THE CIRCUIT COURT FOR BALTIMORE CITY.
