TITLE 10. BUSINESS REGULATION.
SUBTITLE 1. PAWN SHOPS.
10-101. DEFINITION.
IN THIS SUBTITLE "PAWN SHOPS" INCLUDES ANY BUSINESS
ESTABLISHMENT WHERE GOODS ARE ACCEPTED AS SECURITY FOR THE LOAN
OF MONEY OR OTHER CONSIDERATION.
10-102. LICENSES.
A PERSON MAY NOT OPERATE A PAWN SHOP WITHOUT OBTAINING A
LICENSE FROM THE CLERK OF THE CIRCUIT COURT. THIS LICENSE SHALL
BE ISSUED ANNUALLY AND THE ANNUAL FEE SHALL BE $200. THE LICENSE
SHALL EXPIRE ON JULY 1 OF EACH YEAR. ONE LICENSE IS REQUIRED FOR
EACH PLACE OF BUSINESS AND THE LICENSE SHALL BE DISPLAYED IN A
CONSPICUOUS PLACE AT THE PLACE OF BUSINESS.
10-103. CERTIFICATION.
ANY APPLICANT FOR A PAWN SHOP LICENSE SHALL PRESENT TO THE
CLERK A CERTIFICATE FROM THE MARYLAND STATE POLICE INDICATING
WHETHER THE RECORDS OF THAT ORGANIZATION SHOW THAT THE APPLICANT
HAS BEEN CONVICTED OF ANY CRIMES, AND IF SO, SPECIFYING THE
PARTICULAR CRIMES. IF THE APPLICANT HAS BEEN CONVICTED OF A
FELONY OR THE CRIME OF RECEIVING STOLEN GOODS, THE CLERK MAY NOT
ISSUE THE LICENSE. ANY LICENSEE CONVICTED OF A FELONY OR THAT
CRIME SHALL HAVE HIS LICENSE REVOKED.
10-104. RECORDS.
EVERY PERSON OPERATING A PAWN SHOP SHALL MAINTAIN RECORDS ON
EACH ITEM ACCEPTED, AND THESE RECORDS SHALL BE KEPT FOR A 3 YEAR
PERIOD. THESE RECORDS SHALL CONTAIN A FULL DESCRIPTION OF THE
ARTICLE PAWNED, THE PAWN TICKET NUMBER, AND THE DATE PAWNED. A
COPY OF THE RECORDS FOR EACH ARTICLE PAWNED SHALL BE SUBMITTED TO
THE MARYLAND STATE POLICE WITHIN 24 HOURS AFTER THE ARTICLE HAS
BEEN ACCEPTED.
10-105. PAWN TICKET.
AN ARTICLE MAY NOT BE ACCEPTED BY A PAWN SHOP WITHOUT THE
PREPARATION OF A NUMBERED PAWN TICKET FOR THAT ARTICLE. PART OF
THE TICKET SHALL BE GIVEN THE PLEDGOR OF THE ARTICLE AND PART
SHALL BE RETAINED BY THE PAWN SHOP. THE PART RETAINED SHALL
CONTAIN THE SIGNATURE AND ADDRESS OF THE PLEDGOR. EACH ARTICLE
SHALL BE MARKED WITH THE NUMBER OF ITS PAWN TICKET. A PAWN SHOP
MAY NOT ACCEPT ANY ARTICLE FROM ANY PLEDGOR UNDER THE AGE OF 18.
A PAWN SHOP MAY NOT SELL ANY ITEM ACCEPTED AS SECURITY WITHIN 15
DAYS AFTER TAKING POSSESSION OF THE ARTICLE.
10-106. PENALTIES.
