CHAPTER 671

(House Bill 1007)

AN ACT concerning

Worcester County - Alcoholic Beverages - Consumption

FOR the purpose of prohibiting in Worcester County alcoholic
beverages from knowingly being consumed, possessed, or
transferred on the premises of certain businesses, clubs,
organizations, or persons that are operated in a certain
manner, and are not licensed under the alcoholic beverages
laws; providing exceptions; authorizing the Worcester County
board of license commissioners to make exemptions from this
Act on a case by case basis; authorizing the Board to adopt
rules for the administration of this Act; providing a
penalty for violating this Act; and generally relating to
the consumption of alcoholic beverages in Worcester County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
-MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

86.

(K) (1) IN WORCESTER COUNTY, IF THE PREMISES CONSTITUTE A
RESTAURANT, TAVERN, HOTEL, CLUB, DANCE STUDIO, DISCO, OR PLACE OF
PUBLIC ENTERTAINMENT, A PERSON, CLUB, ORGANIZATION, OR PLACE OF
PUBLIC ENTERTAINMENT MAY NOT KNOWINGLY ALLOW THE CONSUMPTION,
POSSESSION, OR TRANSFER OF ALCOHOLIC BEVERAGES EXCEPT IN A MANNER
SPECIFICALLY PERMITTED OR PROVIDED FOR BY THIS ARTICLE IF:

(I)  THE PERSON, CLUB, ORGANIZATION, OR PLACE OF
PUBLIC ENTERTAINMENT IS IN POSSESSION OR CONTROL OF THE PLACE AS
OWNER, LESSEE, OR USER; AND

(II)  THE PLACE IS OPEN TO THE GENERAL PUBLIC OR
IN ANY WAY LICENSED BY THE STATE OF MARYLAND OR BY WORCESTER
COUNTY; AND .

(III) THE PLACE IS NOT THE ROOM OF A REGISTERED
GUEST IN A HOTEL, MOTEL, OR HOSPICE OR THE PROPERTY OF A
VOLUNTEER FIRE COMPANY, BONA FIDE CATERING ESTABLISHMENT,

COMMUNITY OR CIVIC ASSOCIATION, SWIM CLUB, OR BONA FIDE SOCIAL,
