(3) Examine an individual under oath; and

(4) Compel the production of records, books, papers,
contracts or other documents.]

(E) IN THE COURSE OF ANY EXAMINATION OR INVESTIGATION MADE
UNDER THIS SECTION, THE BANK COMMISSIONER MAY:

(1) SUBPOENA WITNESSES;

(2) ADMINISTER OATHS;

(3) EXAMINE AN INDIVIDUAL UNDER OATH; AND

(4) COMPEL THE PRODUCTION OF RECORDS, BOOKS, PAPERS,
CONTRACTS OR OTHER DOCUMENTS.

Any person who willfully violates any provision of § 12-503
or § 12-505 of this subtitle OR ANY CODE OF CONDUCT ADOPTED
UNDER IT is guilty of a misdemeanor and on conviction is subject
to a fine not exceeding [$1,000] $5,000 or imprisonment not
exceeding [6 months] 1 YEAR or both.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.

(House Bill 940)

AN ACT concerning

County Board of Education Employees - Tort Liability

FOR the purpose of requiring a county board of education to be
joined in any tort claim against a county board of education
employee; providing that certain issues may be tried
separately in certain actions against a county board
employee; providing that a county board employee is not
liable for damages in certain situations; and generally
relating to the tortious acts or omissions of employees of
county boards of education.
