LAWS OF MARYLAND

Ch. 654

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 40A - Maryland Public Ethics Law

1-201.

(a)  In this article, the following words have the meanings
indicated unless:

(1)  The context clearly requires a different meaning;
or

(2)  A different definition is adopted for a
particular title or provision.

(b)  "Advisory body" means, with respect to questions
arising under Title 3 and Title 4, a body designated by the Court
of Appeals for the purpose of issuing advisory opinions with
respect to a State official of the judicial branch, or, with
respect to questions arising under Title 3, the Joint Committee
on Legislative Ethics with respect to a State official of the
legislative branch, or, with respect to all other questions, the
Ethics Commission.

(c)  "Board" or "commission" means a board, commission,
council, or any other executive agency, however denominated,
comprised of two or more appointed members all of whom serve on a
part-time basis.

(d)  "Business" or "business entity" includes any entity,
regardless of form.

(e)  "Doing business with the State" means being

(1)  A party to any one or any combination of sales,
purchases, leases, or contracts to, from, or with the State, or
any agency thereof, involving consideration of $5,000 or more on
a cumulative basis during the calendar year for which a required
statement is to be filed (as of the awarding or execution of a
contract or lease, the total then ascertainable consideration
thereby committed to be paid, regardless of the period of time
over which such payments are to be made, shall be included); or

(2)  A registrant; or

(3)  Regulated by the executive agency of the official
or employee.

(f)  "Commission" means the State Ethics Commission.

(g)  "Committee" means the Joint Committee on Legislative
Ethics.
