(ii) "Conveyance" does not include a carrying
or transporting device, with a capacity of less than 300 gallons,
when used by a farmer while actually engaged in the business of
farming.

(2)  "Operator" means a person in actual physical
control of a vehicle or vessel.

(3)  "Petroleum products" means motor vehicle fuel AND
AVIATION FUEL [, residual oils number 4, 5, and 6, and all grades
of jet (turbo) fuel].

(4)  "Petroleum transporter" means a person, firm,
corporation, or partnership engaged in transporting petroleum
products, in interstate or intrastate commerce, in a conveyance,
whether or not the conveyance is owned by the transporter.

(5)  "Pipeline" means a line of pipes used for
transporting petroleum products by a person, firm, partnership,
or corporation operating under authority of the Interstate
Commerce Commission.

(6)  "Tank car" means a railroad conveyance used in
transporting bulk petroleum products.

(7)  "Vehicle" means a conveyance for transporting
petroleum products on the roads and highways of this State.

(8)  "Vessel" means a boat, ship, tanker, or barge,
self-propelled or otherwise, used for transporting petroleum
products on the waters of this State.

(b)  (1) Every petroleum transporter shall register with the
Comptroller and shall register each conveyance used by him for
transporting petroleum products wholly within, into or out of the
State. The Comptroller shall prescribe the forms used for
registration.

(2)  Every registration shall be renewed annually on
or before [April 15] OCTOBER 1. Every registration expires on
[April 14] SEPTEMBER 30 unless sooner cancelled, suspended, or
revoked. EVERY REGISTRATION OUTSTANDING ON JULY 1, 1985, SHALL
NOT EXPIRE UNTIL SEPTEMBER 30, 1986.

(3)  A petroleum transporter shall notify the
Comptroller of any changes in registration information within 30
days of such changes.

(c)  (1) The Comptroller shall assign an identification
marker to be affixed in a prominent place to every vehicle
transporting petroleum products registered by a petroleum
transporter. Petroleum products may not be placed in or on any
vehicle which does not display a valid identification marker.
