REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §
89A(a)(l).

In subsection (a)(1) of this section, the words "from
the State or its units or both", which follow
"receive", are new language added for clarity.

In subsection (a)(l)(iii) of this section, the words
"regardless of the manner in which, or whether or not,
the ownership interest is stated or registered on the
stock", which formerly followed "business", are
deleted as surplusage.

21-203. PENALTIES.

A BUSINESS OR AN OFFICER OF A BUSINESS WHO VIOLATES ANY
PROVISION OF THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND ON
CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $10,000.

SUBTITLE 3. NOTICE OF BIDS ON AND AWARDS OF
CERTAIN CONTRACTS.

21-301. "CONSTRUCTION PROJECT" DEFINED.

IN THIS SUBTITLE, "CONSTRUCTION PROJECT" INCLUDES NEW
CONSTRUCTION AND AN ALTERATION, RENOVATION, OR ADDITION.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first half of
former Art. 41, § 256F(j)(l), as it described what
"construction projects" include.

21-302. REQUIRED NOTICE OF CONTRACTS FOR CERTAIN CONSTRUCTION
PROJECTS.

(A) REQUESTS FOR BIDS.

NOTICE OF A REQUEST FOR BIDS ON A STATE CONSTRUCTION PROJECT
FOR WHICH THE BID AMOUNT IS REASONABLY EXPECTED TO EXCEED $25,000
SHALL BE PUBLISHED IN THE MARYLAND REGISTER AT LEAST 30 DAYS
BEFORE THE BID OPENING DATE.. ANY NOTICE PUBLISHED LESS THAN 30
DAYS BEFORE THE BID OPENING DATE IS DEFECTIVE UNLESS THE
CONSTRUCTION PROJECT IS EXEMPT FROM COMPETITIVE BIDDING BY STATE
LAW OR REGULATION. IF THE BID OPENING DATE IS POSTPONED,
ADDITIONAL NOTICE OF THE REQUEST FOR BIDS IS NOT REQUIRED IF THE
ORIGINAL NOTICE WAS PUBLISHED AT LEAST 30 DAYS BEFORE THE
ORIGINAL BID OPENING DATE.
