21-101. POWER OF BOARD.

BY REGULATION, THE BOARD OF PUBLIC WORKS MAY REQUIRE THAT
ANY PROPOSED CONTRACT, CONTRACT RENEWAL, OR ATTENDANT CHANGE
ORDER, OF A DESIGNATED CLASS OR MONETARY VALUE, OF ANY UNIT OF
THE EXECUTIVE BRANCH OF THE STATE GOVERNMENT BE BROUGHT TO THE
BOARD FOR CONSIDERATION AND APPROVAL BEFORE EXECUTION. THE
PROVISIONS OF THIS SECTION SUPPLEMENT OTHER POWERS OF THE BOARD
OF PUBLIC WORKS.

REVISOR'S NOTE: This section formerly appeared as Art. 78A,
§ 68.

The word "unit" is substituted for the former language
"State department, board, commission, institution, or
other agency", for brevity and consistency with
language used elsewhere in this article.

The only other changes are in style.

Former Art. 78A, § 1B, which stated that the Board of
Public Works has authority "over the procurement,
management, and control of all ... items acquired by
the State", is deleted as redundant of § 12-101(a) of
this article.

SUBTITLE 2. DISCLOSURES REQUIRED FROM CERTAIN CONTRACTORS.

21-201. DEFINITION; RULE OF CONSTRUCTION.

(A)  "BENEFICIAL OWNERSHIP" DEFINED.

IN THIS SUBTITLE, "BENEFICIAL OWNERSHIP" MEANS:

(1)  ANY OWNERSHIP INTEREST OF 5% OR MORE IN A
BUSINESS;

(2)  ANY OWNERSHIP INTEREST OF 5% OR MORE IN 1 OR MORE
OTHER ENTITIES IN A CHAIN OF PARENT AND SUBSIDIARY ENTITIES, ANY
1 OF WHICH PARTICIPATES IN AT LEAST 5% OF THE CAPITAL OR PROFITS
OF A BUSINESS; OR

(3)  POSSESSION OF AN INTEREST THAT EXISTS UNDER AN
AGREEMENT, CONTRACT, RELATIONSHIP, UNDERSTANDING, OR OTHER
ARRANGEMENT AND ENTITLES A PERSON TO BENEFITS SUBSTANTIALLY
EQUIVALENT TO AN OWNERSHIP INTEREST OF 5% OR MORE OF A BUSINESS.

(B)  RULE OF CONSTRUCTION.

IN THIS SUBTITLE, UNLESS THERE ARE SPECIAL CIRCUMSTANCES, AN
INDIVIDUAL IS DEEMED TO HOLD AN OWNERSHIP INTEREST THAT IS HELD
BY THE INDIVIDUAL'S SPOUSE, THE INDIVIDUAL'S CHILD, OR OTHER
RELATIVE OF THE INDIVIDUAL WHO LIVES IN THE INDIVIDUAL'S HOME.
