HARRY HUGHES, Governor                                     2809

submit a written request for permission to build the
facility or institution to the Secretary of Public Safety
and Correctional Services in the case of certain adult
facilities, and to the Secretary of Health and Mental
Hygiene in the case of certain juvenile facilities; and
requiring the respective Secretary to approve or disapprove
the request under certain conditions.

BY adding to

Article 41 - Governor - Executive and Administrative

Departments
Section 204G-11 to be under the new subheading "Out-of-State

Prison Facilities and Correctional Institutions"
Annotated Code of Maryland
(1982 Replacement Volume and 1984 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 41 - Governor - Executive and Administrative

Departments

OUT-OF-STATE PRISON FACILITIES
AND CORRECTIONAL INSTITUTIONS

204G-11.

(A)  BEFORE ANY OTHER STATE OR THE DISTRICT OF COLUMBIA
BUILDS MAY BEGIN CONSTRUCTION ON OR OTHERWISE LOCATE A PRISON
FACILITY OR CORRECTIONAL INSTITUTION OF ANY KIND FOR ADULTS OR
JUVENILES IN THIS STATE, THE STATE OR THE DISTRICT OF COLUMBIA
SHALL SUBMIT A WRITTEN REQUEST FOR PERMISSION TO BUILD THE
FACILITY OR INSTITUTION TO THE SECRETARY OF PUBLIC SAFETY AND
CORRECTIONAL SERVICES IN THE CASE OF ADULT FACILITIES, OR TO THE
SECRETARY OF HEALTH AND MENTAL HYGIENE IN THE CASE OF JUVENILE
FACILITIES.

(B)  UPON CONSULTATION WITH THE GOVERNOR, LOCAL ELECTED
OFFICIALS GOVERNING BODY OF THE COUNTY, AND THE COMMUNITY IN
WHICH THE FACILITY OR INSTITUTION IS PLANNED TO BE LOCATED, AND
IN ACCORDANCE WITH NORMAL APPLICABLE STANDARDS CONCERNING THE
LOCATION OF PRISON FACILITIES AND CORRECTIONAL INSTITUTIONS, THE
SECRETARY OF PUBLIC SAFETY AND CORRECTIONAL SERVICES MAY APPROVE
OR DISAPPROVE THE REQUEST FOR PERMISSION TO BUILD THE FACILITY OR
INSTITUTION IN THE CASE OF ADULT FACILITIES. THE SECRETARY OF
HEALTH AND MENTAL HYGIENE MAY APPROVE OR DISAPPROVE THE REQUEST
FOR PERMISSION TO BUILD THE FACILITY OR INSTITUTION IN THE CASE
OF JUVENILE FACILITIES. AND CORRECTIONAL INSTITUTIONS:

(1) IN THE CASE OF ADULT FACILITIES, THE SECRETARY OF
PUBLIC SAFETY AND CORRECTIONAL SERVICES MAY APPROVE OR DISAPPROVE
THE REQUEST FOR PERMISSION TO BUILD THE FACILITY OR INSTITUTION;
