(4) [Each such licensee having a total wager in
excess of $166,666.67 daily average during the racing season, in
any one year similarly shall pay to the Harness Racing Commission
for the use of the State, breakage computed to ten cents (10¢) on
the entire amount thereof provided, however, that each such
licensee shall deduct and retain one half of the breakage
computed to ten cents (10¢) on the amount wagered on races
conducted by the licensee which shall be allocated by the
licensee to pay the cost of track maintenance, physical
improvements, payments on any indebtedness related to the
facility (including, without limitation, clubhouse and grandstand
construction) previously or hereafter incurred, and
personnel-related expenses.]
(I) EACH LICENSEE HAVING A TOTAL WAGER NOT IN
EXCESS OF $150,000 DAILY AVERAGE ON ALL RACES CONDUCTED BY IT
SHALL RETAIN THE BREAKAGE COMPUTED TO 10 CENTS ON ALL AMOUNTS
WAGERED.
(II) EACH LICENSEE HAVING A TOTAL WAGER IN
EXCESS OF $150,000 DAILY AVERAGE ON ALL RACES CONDUCTED BY IT
SHALL ALLOCATE THE BREAKAGE COMPUTED TO 10 CENTS ON ALL AMOUNTS
WAGERED AS FOLLOWS:
1. 50 PERCENT TO THE MARYLAND
STANDARDBRED RACE FUND SIRES STAKES PROGRAM; AND
2. 50 PERCENT TO PAY THE COST OF TRACK
MAINTENANCE, PHYSICAL IMPROVEMENTS, PAYMENTS ON ANY INDEBTEDNESS
RELATED TO THE FACILITY, INCLUDING, WITHOUT LIMITATION, CLUBHOUSE
AND GRANDSTAND CONSTRUCTION, PREVIOUSLY OR HEREAFTER INCURRED,
AND PERSONNEL-RELATED EXPENSES.
[(7) Each licensee licensed under the provisions of
this section shall, in addition to the other taxes and fees
imposed under the provisions of this article, pay annually to the
Maryland Agricultural Fair Board a sum representing one tenth of
one per centum of all money wagered in excess of two million
dollars ($2,000,000) with a maximum of three thousand five
hundred dollars ($3,500.00) from each licensee. In addition each
licensee shall allocate a sum equal to 1/2% of the regular and
the two horse multiple mutuel pools and 1 percent of the three or
more horse multiple mutuel pool in all races conducted by it
during the year to the Maryland Standardbred Race Fund as
provided by § 17A of this article.]
(8) In addition each licensee shall allocate from its
share of all money wagered in excess of [$125,000] $150,000 daily
average on all races conducted by it during the year [(1) a sum
equal to 0.50 percent to the Maryland Standardbred Fund created
by Section 17A of this article; and (2)] a sum equal to 0.50
percent to be used for purses and to pay the cost of track
maintenance, physical improvements, payments on any indebtedness
related to the facility (including, without limitation, clubhouse
and grandstand" construction) previously or hereafter incurred,
