(2) ANY OTHER STRUCTURE USED TO PROVIDE PROTECTION
FROM RADIATION FALLOUT SHALL BE ASSESSED ON THE BASIS OF THE
DIFFERENCE IN THE VALUE OF THE IMPROVEMENTS TO THE REAL PROPERTY
AS ACTUALLY CONSTRUCTED AND THE VALUE IF CONSTRUCTED OF MATERIALS
SIMILAR TO THE RESIDENCE ON THE PROPERTY.

REVISOR'S NOTE: This section is new language substituted
for former Art. 81, § 19(a)(5) to clarify the current
assessing of radiation fallout shelters.

"Property" § 1-101 "Real property" § 1-101

"Value" § 1-101

8-237. SAME -- SEPTIC SYSTEMS AND WELLS.

A SEPTIC SYSTEM OR A WELL THAT FUNCTIONS IN A DEFICIENT
MANNER SHALL BE ASSESSED TO THE OWNER OF THE REAL PROPERTY ON
WHICH IT IS LOCATED ON THE BASIS OF THE DEFICIENCY, IF:

(1)  THE OWNER OF THE REAL PROPERTY:

(I)  NOTIFIES THE SUPERVISOR; AND

(II)  STATES THAT THE CONDITION AFFECTS THE
VALUE OF THE REAL PROPERTY; AND

(2)  THE SUPERVISOR CONSIDERS THAT THE DEFICIENCY
AFFECTS THE VALUE OF THE REAL PROPERTY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 81, §
19(a)(13).

In the introductory language of this section, the
phrase "to the owner of the real property on which it
is located" is added for clarity.

Also in the introductory language of this section, the
phrase "shall be assessed" is substituted for the
former phrase "shall be considered", for clarity.

Also in the introductory language of this section, the
defined term "real property" is substituted for the
former reference to "property", for accuracy.

Also in the introductory language of this section, the
former phrase "if not reflected in the initial
valuation" is deleted as superfluous.

In item (2) of this section, the defined term "real
property" is added to modify "value", for clarity.

Also in item (2) of this section, the phrase "the
supervisor considers" is added to clarify the former
vague words "shall be considered".
