FOR the purpose of clarifying that, for procurement by the Cecil
County government, a certain exception to the requirement
that certain contracts be competitively bid applies only
when certain requirements are met; and making this Act an
emergency measurer; and making this Act contingent on the
passage of another Act.
BY repealing and reenacting, with amendments,
Article 25 - County Commissioners

Preamble
WHEREAS, Chapter 722 of the Laws of Maryland of 1984
provides an exception for emergency contracts to the requirement
in Cecil County that contracts for any construction or repair of
any bridge or road and any purchase or lease of any road or
construction equipment or machinery by competitively bid; and
WHEREAS, Chapter 722 of the Laws of Maryland of 1984 further
provides that to be an "emergency" contract, a majority vote of
the County Commissioners shall have declared the contract to be
an emergency and the vote shall be a recorded vote taken at a
public meeting; and
WHEREAS, There has been confusion in Cecil County in
determining whether the awarding of contracts by the County
Commissioners has been in compliance with the requirements of
Chapter 722 of the Laws of Maryland of 1984; and
WHEREAS, It has been and continues to be the intention of
the General Assembly of Maryland that to constitute an emergency
contract, the County Commissioners must declare the contract to
be an emergency, before the awarding of the contract, by a
majority vote of the County Commissioners that is recorded and
taken at a public meeting of the County Commissioners; now,
therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 25 - County Commissioners
37A.
(a) (1) Except as provided in subsection (b) of this
section, in Cecil County the following purchases of goods and
services shall be by competitively bid contract awarded to the
lowest responsive and responsible bidder:
(i) Any construction or repair of any bridge or
road; and
