INTEREST. IF ANY DAYS OF RACING ARE REVOKED UNDER THIS
SUBSECTION, THEY MAY BE AWARDED TO ANOTHER LICENSEE,
NOTWITHSTANDING SUBSECTION (C) OF THIS SECTION.
(G) A LICENSEE UNDER SECTION 7 OR SECTION 15 OF THIS
ARTICLE MAY NOT CONDUCT THOROUGHBRED RACING AFTER 6:15 P.M.
EXCEPT FOR EITHER DELAYS CAUSED BY CIRCUMSTANCES BEYOND THE
CONTROL OF THE LICENSEE OR RACE DAYS OF NATIONAL PROMINENCE.
8.
(A) Except in the case of the trotting and pacing meeting,
as hereinafter provided for, and except the corporations and
associations named in § 15, each applicant desiring to hold races
on the days or day awarded by the Commission shall, before the
issuance of any license therefor, pay to the said Commission a
license fee of [one thousand dollars ($1,000)] $25 for each day
of any meeting for the conduct of races so licensed.
(B) THE COMMISSION IS DIRECTED TO SEEK COOPERATION AMONG
THE LICENSEES AS DEFINED IN SECTIONS 7 AND 15, SO THAT WHEN
HORSES ARE STABLED IN SUPPORT OF A RACE MEET AT A MARYLAND TRACK,
DUE CONSIDERATION IS GIVEN IN ASSIGNING HORSEMEN FROM
NORTHEASTERN AREAS OF THE STATE, TO THE EXTENT PRACTICABLE, AND
AT NO CHARGE, TO STALLS NEAREST THE COUNTY OF RESIDENCE OF THE
TRAINER, IF SUCH HORSEMEN ARE ORIGINALLY SELECTED BY THE
MANAGEMENT OF THE LICENSEES AS PROPERLY ELIGIBLE FOR STALL
SPACES.
8A.
(A) THE BOWIE TRACK MAY SHALL BE OPERATED BY ITS OWNERS AS
A THOROUGHBRED TRAINING FACILITY IN ORDER TO PROVIDE ADDITIONAL
STALL SPACE IN SUPPORT OF A RACE MEETING CONDUCTED BY A LICENSEE
UNDER § 7 OF THIS ARTICLE.
(B) THE COST OF OPERATION, MAINTENANCE, AND IMPROVEMENTS TO
THE TRAINING FACILITY ARE THE RESPONSIBILITY OF ITS OWNERS.
(C) AS LONG AS THE TRAINING FACILITY IS USED FOR THE
PURPOSE DESCRIBED IN SUBSECTION (A) OF THIS SECTION, THE
COMMISSION HAS GENERAL REGULATORY JURISDICTION OVER THE TRAINING
FACILITY FOR THE PURPOSES OF:
(1) PROVIDING AN ADEQUATE NUMBER OF STALLS;
(2) MAINTAINING SAFE OPERATING CONDITIONS;
(3) ORDERING REASONABLE IMPROVEMENTS; AND, INCLUDING
AN OVERPASS OR UNDERPASS TO ALLEVIATE TRAFFIC PROBLEMS THAT
HORSES CAUSE ON RACE TRACK ROAD, THE FUNDING OF WHICH SHALL BE
COORDINATED AND IMPLEMENTED BY THE OWNERS, THE COMMISSION, AND
PRINCE GEORGE'S COUNTY; AND
(4) REQUIRING THE SUBMISSION OF ANNUAL OPERATING
FINANCIAL STATEMENTS.
