CHAPTER 309

(House Bill 439)

AN ACT concerning

Calvert County Commissioners - Sheriff's Department -

Pensions

FOR the purpose of authorizing the Board of County Commissioners
of Calvert County to establish a pension plan for certain
sheriff's department employees and other law enforcement
officials; authorizing the Board of County Commissioners of
Calvert County to negotiate for the participation of certain
sheriff's department and other law enforcement personnel in
a State pension plan or program; requiring that any pension
plan established by the Board include certain provisions;
providing for a certain effective date for any pension plan
established by the Board; providing for the inapplicability
of any plan established by the Board to certain persons
covered by a certain other pension plan; providing for the
election by certain persons of whether to participate in a
pension plan established by the Board or an existing pension
plan; and generally relating to the Calvert County Board of
Commissioners and the establishment of a certain pension
plan for sheriff's department employees and certain other
law enforcement officials.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 25 - County Commissioners

(PP) (1) THE BOARD OF COUNTY COMMISSIONERS OF CALVERT
COUNTY MAY ESTABLISH A SEPARATE FULLY FUNDED PENSION PLAN FOR THE
CALVERT COUNTY SHERIFF'S DEPARTMENT. THE PLAN MAY PROVIDE FOR
PARTICIPATION BY:

(I) THE SHERIFF;

(II) (I) EACH DEPUTY SHERIFF WHO IS ACTIVELY
ENGAGED IN LAW ENFORCEMENT;

(III) (II) THE COUNTY JAIL ADMINISTRATOR; AND
