AN ACT concerning

Unemployment Insurance - Deduction of Pension and Severance

Payments

FOR the purpose of requiring the deduction of Social Security
benefits and Railroad Retirement benefits from unemployment
insurance benefits if a base period employer is subject to
the provisions of the Social Security Act or the Railroad
Retirement Act of 1974; repealing the requirement that any
unemployment insurance benefit payment reduced because of
any deductible pension payment or severance pay constitutes
a full week's benefits for computing maximum benefit
eligibility; and providing that this Act shall apply to
individuals who file a claim on or after a certain date.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 95A - Unemployment Insurance Law

An individual shall be disqualified for benefits:

(g) (1) For any week with respect to which he is receiving
or has received an amount, calculated pursuant to paragraphs (i)
and (ii), equal to or in excess of his weekly benefit amount in
the form of a pension, annuity or retirement or retired pay, or
any other similar periodic payment which is based on any previous
insured work of the individual for a base period employer (but
excluding payments from a state or federal workmen's compensation
program) under a plan paid for in whole or in part by a base
