CHAPTER 267

(House Bill 173)

AN ACT concerning

Frederick County and the City of Frederick - Alcoholic Beverages

FOR the purpose of authorizing the Frederick County Commissioners
to adopt ordinances or resolutions supplementing the State
law prohibiting disorderly intoxication, including the
authority to regulate the possession or consumption of
alcoholic beverages on certain property; authorizing the
Mayor and Aldermen of the City of Frederick to regulate
within the City limits certain activities relating to
alcoholic beverages; and including Frederick County with
those counties restricting the possession of open alcoholic
beverages containers in certain places.

BY repealing and reenacting, without amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

207.

(a) A person may not:

(1)  Be intoxicated and endanger the safety of another
person or property; or

(2)  Be intoxicated or drink any alcoholic beverage in
a public place and cause a public disturbance.
