(II) THE APPLICATION IS FILED NOT MORE THAN 36
MONTHS AFTER THE MONTH IN WHICH MEMBERSHIP TERMINATED.

(B) IF THE APPLICATION OF A FORMER MEMBER IS ACCEPTED
AND A DISABILITY RETIREMENT IS GRANTED, THE RETIREMENT ALLOWANCE
SHALL COMMENCE AS OF THE FIRST DAY OF THE MONTH FOLLOWING RECEIPT
OF THE APPLICATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.

AN ACT concerning

Pensions - Filing of Disability Application

FOR the purpose of providing a certain period after termination
of membership in the pension systems for employees and
teachers for former members to apply for ordinary and
accidental disability retirement.

BY repealing and reenacting, with amendments,

Article 73B - Pensions

Section 117(5) and (7) and 145(5) and (7)

Annotated Code of Maryland

(1983 Replacement Volume and 1984 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 73B - Pensions

117.

(5) (a) On the application of a member or of his department
head, any member who has had 5 or more years of eligibility
service may be retired by the board of trustees on an ordinary
disability retirement allowance, if the medical board, after a
medical examination of the member, certifies that:

(i) The member is mentally or physically
incapacitated for the further performance of duty;
