8-404.
(b) (1) (I) In cooperation with the Motor Vehicle
Administration, courts, police, and other agencies, the
[Alcoholism Control Administration] DEPARTMENT shall [propose]
APPROVE appropriate programs of alcoholism education or treatment
for individuals who, under § 21-902 of the Transportation
Article, are convicted of driving while intoxicated or while
under the influence of alcohol.
[(2)] (II) The programs under this [subsection]
PARAGRAPH shall be coordinated with and integrated into broad
planning for comprehensive community health and welfare services.
(2) THE DEPARTMENT SHALL:
(I) REVIEW AND, IN ACCORDANCE WITH REGULATION
THAT THE DEPARTMENT SHALL ADOPT, APPROVE OR DISAPPROVE EACH
PROGRAM THAT A PUBLIC OR PRIVATE AGENCY WANTS TO OFFER UNDER
ARTICLE 27, § 639(B) OR § 641(A)(1)(II) OF THE CODE;
(II) GIVE PROMPTLY THE ADMINISTRATIVE OFFICE OF
THE COURTS NOTICE OF EACH PROGRAM APPROVED UNDER THIS PARAGRAPH;
(III) MONITOR AND BIENNIALLY REVIEW EACH
PROGRAM APPROVED UNDER THIS PARAGRAPH;
(IV) INVESTIGATE EACH COMPLAINT MADE IN
CONNECTION WITH A PROGRAM; AND
(V) GIVE PROMPTLY THE ADMINISTRATIVE OFFICE OF
THE COURTS NOTICE IF THE DEPARTMENT WITHDRAWS ITS APPROVAL OF ANY
PROGRAM.
SECTION 3. AND BE IT FURTHER ENACTED, That any programs
that, as of the effective date of this Act, are approved by the
Administrative Office of the Courts shall continue to be
approved, for use under Article 27, §§ 639(b) and 641(a)(1)(ii)
of the Code, unless the Department of Health and Mental Hygiene
withdraws approval under this Act.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.
