The Board, on the affirmative vote of a majority of its full
authorized membership, may reinstate the [certification] LICENSE
of an individual whose certification has been revoked.

Subtitle 4. Prohibited Acts; Penalties

5.5-401.

(a)  Unless a person is- [certified as a registered
environmental sanitarian] LICENSED under this title, the person
may not represent to the public that the person is a registered
environmental sanitarian.

(b)  Unless a person is [certified as a registered
environmental sanitarian] LICENSED under this title, the person
may not use the title "registered environmental sanitarian" or
the initials "R.S." after the name of the person.

5.5-402.

A person who violates any provision of § [5.5-102] 5.5-301
or § 5.5-401 of this subtitle is guilty of a misdemeanor and on
conviction is subject to a fine not exceeding $100 or
imprisonment not exceeding 60 days or both.

SECTION 2. AND BE. IT FURTHER ENACTED, That this Act is
hereby declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety and having
been passed by a yea and nay vote supported by three-fifths of
all the members elected to each of the two Houses of the General
Assembly, the same shall take effect from the date of its
passage.
