Ch. 173

(1)  IF THE OWNER, TENANT, OR OCCUPANT OF A PARCEL OF
LAND DOES NOT STOP DISPOSING OF SEWAGE OR INDUSTRIAL WASTES AS
REQUIRED BY SUBSECTION (E) OF THIS SECTION, ANY POLITICAL
SUBDIVISION OR PERSON WHO SUPPLIES OR SELLS WATER FOR USE ON THE
PARCEL OF LAND SHALL STOP SUPPLYING OR SELLING THE WATER WITHIN 5
DAYS AFTER RECEIVING NOTICE OF THE DELINQUENCY FROM THE
AUTHORITY.

(2)  IF A POLITICAL SUBDIVISION OR PERSON DOES NOT
STOP SUPPLYING OR SELLING WATER FOR USE ON A PARCEL OF LAND AS
REQUIRED BY PARAGRAPH (1) OF THIS SUBSECTION, THE AUTHORITY MAY
SHUT OFF THE SUPPLY OF WATER TO THE PARCEL OF LAND.

REVISOR'S NOTE: This section is new language derived
without, substantive change from former HE § 9-914(a).

In subsections (c) and (d) of this section, the former
references to a project that is "acquired,
constructed, or operated by the authority under this
subtitle" are deleted as unnecessary in light of the
definition of "project" in § 9-901 of this subtitle.

In subsections (d), (e), and (f) of this section, the
references to "parcel of land" are substituted for the
former references to "premises" to conform to the
provisions of subsection (c) of this section. The
intent behind these provisions is to disconnect all
water and sewerage services to the entire parcel of
land where a structure or other premises is located,
instead of just those services that are used by some
of the premises on the parcel of land. No substantive
change is intended by this substitution.

In subsection (d)(1) of this section, "sewerage
system" is substituted for the former reference to
"sewer system", for clarity.

In subsection (d)(2) of this section, "recover" is
substituted for the former reference to "proceed to
recover", for clarity.

In subsection (e) of this section, "owned" is
substituted for the former word "acquired" to conform
to similar references throughout this subtitle.

In subsection (f) of this section, the former
references to "private corporation", "board", and
"body" are deleted as unnecessary in light of the
definition of "person" in § 1-101 of this article.

9-940. HOLDER OF BONDS MAY PROTECT AND ENFORCE RIGHTS.

SUBJECT TO ANY RESTRICTION IN THE RESOLUTION OR TRUST
AGREEMENT THAT PROVIDES FOR THE ISSUANCE OF OR SECURES THE BONDS
OF AN AUTHORITY, ANY HOLDER OF THE BONDS, ANY HOLDER OF ANY
