(II) MARK THE DATE AND TIME OF RECEIPT TO THE
ARTICLES; AND
(III) ISSUE A CERTIFICATE OF APPROVAL FOR ANY
ARTICLES THAT COMPLY WITH THIS SUBTITLE.
(2) WHEN THE STATE DEPARTMENT OF ASSESSMENTS AND
TAXATION ISSUES A CERTIFICATE OF APPROVAL, THE ARTICLES OF
WITHDRAWAL OR ARTICLES OF JOINDER:
(I) ARE IN FULL FORCE AND EFFECT; AND
(II) ARE CONCLUSIVELY' CONSIDERED TO BE LAWFULLY
AND PROPERLY ADOPTED.
REVISOR'S NOTE: This section is new language derived
without substantive change from former HE § 9-904.
In subsection (a)(2) of this section, the former
reference that allowed only those political
subdivisions "not having joined in the original
incorporation" to join an authority is deleted as
ambiguous and as an unnecessary restriction on the
following rights of a political subdivision: (1) The
right of a political subdivision that was an original
incorporator to rejoin an authority after the
political subdivision has withdrawn from the
authority; and (2) The right of any other political
subdivision that has joined and withdrawn from an
authority to rejoin the same authority. Even though
subsection (a)(2) of this section, as revised, allows
any political subdivision to join an authority, no
change of substance is intended by deleting the former
limitation in this subsection.
In subsection (c)(2) and (3) of this section, the
references to "authorized" officers of political
subdivisions and "authorized" directors of authorities
are substituted for the former references to "proper"
officers, for clarity.
Also in subsection (c)(2) and (3) of this section, the
reference to "sign and acknowledge" is substituted for
the former word "executed", for clarity to conform to
CA § 2-102.
As to subsection (c)(2)(ii) and (3)(ii) and (iii) of
this section, the requirement that the authorized
officers of the authority and the authorized officers
of each member political subdivision "sign and
acknowledge" the articles of withdrawal or the
articles of joinder is substituted for the former
reference that required these articles to be joined by
these persons, for clarity.
