[(1)] (M) (1) A court may award reasonable attorney's fees
to a prevailing plaintiff under this section.

(2) If it appears to the satisfaction of the court
that an action is brought in bad faith or is of a frivolous
nature, the court may order the offending party to pay to the
other party reasonable attorney's fees.

[(m)] (N) This subtitle does not apply to a fleet purchase
of five or more motor vehicles.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
be construed only prospectively and may not be applied or
interpreted to have any effect upon or application to any new
motor vehicle purchased or delivered prior to the effective date
of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985 January 1, 1986.

AN ACT concerning

Vehicle Laws - Motor Carrier Road Tax

FOR the purpose of excluding certain vehicles or combinations of
vehicles of a certain weight from the definition of
"commercial motor vehicle" that determines the vehicles that
are subject to the road tax for motor carriers; altering the
definitions of nonfreight trailers and semitrailers and of
freight trailers and semitrailers; altering certain
registration fees applicable to certain trailers and
semitrailers; generally relating to trailers and
semitrailers; generally relating to the definition of
"commercial motor vehicle" under the provision of law
relating to the road tax on motor vehicles; and providing
that this Act is an emergency measure.

BY repealing and reenacting, with amendments,
