(I)  EXCLUSIVELY FOR RELIGIOUS WORSHIP; OR

(II)  TO PROVIDE NURSING CARE, DOMICILIARY CARE,
OR COMPREHENSIVE CARE, INCLUDING:

1.  THE PART OF ANY CENTRAL ADMINISTRATIVE
OR SERVICE FACILITY THAT IS REASONABLY ALLOCABLE TO THE LICENSED
HEALTH CARE PART OF THE FACILITY; OR

2.  THE PART OF ANY LAND THAT IS
REASONABLY ALLOCABLE TO THE LICENSED HEALTH CARE PART OF. THE
FACILITY.

REVISOR'S NOTE: Subsections (a)(1), (2), and (4) and (b) of
this section are new language derived without
substantive change from former Art. 81, § 9(a),
(e-2)(l) and (2).

Subsection (a)(3) of this section is new language
added to clarify that the Office on Aging must certify
a facility before the facility may provide "continuing
care". As to the prohibition for operating a facility
without a certificate of registration, see Art. 70B, §
18 of the Code.

In the introductory language of subsection (a) of this
section, the defined term is changed from the former
term "continuing care facility for the aged" to
"facility", for brevity.

In subsection (a)(2) of this section, the reference to
"a related institution under Title 19, Subtitle 3" is
added to clarify that the described facility is
licensed by the Department of Health and Mental
Hygiene as a domiciliary care facility or a
comprehensive care facility under HG § 19-318.

In subsection (b)(2)(ii)l. and 2. of this section,   the

references to "the licensed health care part of"   the

facility are added to clarify the scope of the
exemption.

Former Art. 81, § 9(e-2)(3), which provided for an
effective date, is deleted as obsolete.
