CHAPTER 107

(Senate Bill 492)

AN ACT concerning

Health Care Cost Containment - Certificate of Need--
Licensing - Major Medical Equipment

FOR the purpose of reducing the long-term costs of health care by
requiring a certificate of need license before certain
medical equipment may be leased or, acquired, or used by

certain health care professionals or private entities

providing health-care services, repealing certain provisions
which require a certificate of need for certain medical
equipment; exempting from the certificate of need process a
change in health care services which would result from the
lease, acquisition, or use of medical equipment; defining
certain terms; requiring the Secretary of Health and Mental

Hygiene to adopt certain regulations concerning the

licensing of major medical equipment; providing for the
licensing procedures and requirements; providing for the
renewal of the license; providing for license application
and license renewal fees; exempting certain equipment from
the requirements for payment of fees; providing for the

denial or revocation of a license under certain

circumstances; providing for notice and an opportunity to be
heard before certain actions are taken by the Secretary of
