addresses services not related to direct patient care that do not
increase net patient revenues to the applicant facility and do
increase the effectiveness and efficiency of the applicant
facility.

Further, the Commission may receive and act on any
certificate of need application by or on behalf of a hospital as
defined in § 19-301 of the Health - General Article that the
Commission finds in its sole discretion will result in a
reduction in hospital service capacity in the State and will not
increase hospital revenues.

Further, the Commission shall, after consultation with the
Health Services Cost Review Commission, receive and act on any
certificate of need application where a letter notice of intent
was received prior to February 1, 1985 and the application is:

A. From a general hospital as defined in Section 19-307 of
the Health - General Article if:

I. The application would result in a decrease in
total licensed bed capacity, and does not include a conversion of
hospital bed capacity to other inpatient health care bed uses; or

II. The application is from a hospital that is the
only licensed general hospital in a county and there is a need
identified for 1983-1988 in the State Health Plan effective
February 1, 1985 for more than 15 acute care beds in the county
where the hospital is located; or

(III) The application is part of a comparative review
involving alcohol rehabilitation services.

B. For the construction of a general hospital as defined in
Section 19-307 of the Health - General Article, where the
hospital is proposed to be located in a county where no general
hospital exists.

C. From an existing special hospital as defined in Section
19-307 of the Health - General Article that proposes to renovate
or replace an existing facility , or from an existing alcohol
abuse facility as defined in Section 8-411 of the Health
General Article that proposes to convert to a special hospital
and for which no capital expenditure would be incurred.

Further, the Commission shall act on any certificate of need
application for the relocation and expansion of an existing
kidney dialysis facility if the application or addendum to the
application was submitted before the effective date of this Act.

Further, that on request by a person whose application has
been affected by this Act, the Commission shall resume
consideration of that application on October 1, 1985, prior to
the Commission's consideration of any new application received on
or after October 1, 1985.
