In subsection (d) of this section, the former
references to "rules" are deleted as included in the
references to "regulations" since it is the practice
of the Division of State Documents to use "rule" with
respect to judicial or legislative units and
"regulation" with respect to other units.

In subsection (d)(1) of this section, the former words
"amend" and "repeal" are deleted as superfluous since
the amendment or repeal of a regulation is
accomplished through the adoption of a later
regulation.

The first and second sentences of former Art. 81, §
224A(b), which provided for the publication of
proposed regulations and for a hearing on proposed
regulations, are deleted as misleading and, in any
event, superfluous in light of the provisions of Title
10, Subtitle 1 of the State Government Article
"Administrative Procedure Act -- Regulations".

TITLE 4. COLLECTORS.

SUBTITLE 1. GENERAL PROVISIONS.

4-101. POSITION; APPOINTMENT; OATH; COMPENSATION.

(A)  POSITION ESTABLISHED.

THERE IS A COLLECTOR FOR EACH COUNTY IN THE STATE.

(B)  APPOINTMENT.

EXCEPT AS OTHERWISE PROVIDED BY LAW, FOR EACH COUNTY, THE
GOVERNING BODY OF THE COUNTY SHALL APPOINT A COLLECTOR ON OR
BEFORE JANUARY 1 OF EACH YEAR.

(C)  OATH.

BEFORE TAKING OFFICE, EACH COLLECTOR SHALL TAKE THE OATH
REQUIRED BY ARTICLE I, § 9 OF THE MARYLAND CONSTITUTION.

(D)  COMPENSATION.

(1) A COLLECTOR IS ENTITLED TO THE COMPENSATION
PROVIDED IN THE COUNTY BUDGET.

(2) A COLLECTOR MAY NOT RECEIVE SEPARATE COMPENSATION
FROM THE STATE FOR COLLECTING STATE TAXES.
