REVISOR'S NOTE: This section is new language derived
without substantive change from the second sentence of
former Art. 81, § 248(b)(1).

The introductory phrase "[f]rom among the regular
members of each board" is added for clarity.

3-105. QUORUM; MEETINGS; DECISIONS EVIDENCED BY ORDER;
COMPENSATION AND REIMBURSEMENT; STAFF.

(A)  QUORUM.

TWO MEMBERS OF A BOARD ARE A QUORUM TO DO BUSINESS.

(B)  DECISIONS EVIDENCED BY ORDER.

(1)  THE BOARD SHALL ISSUE AN ORDER THAT SETS FORTH
ITS DETERMINATION OF ANY MATTER BROUGHT BEFORE IT. TWO MEMBERS
OF A BOARD SHALL SIGN THE ORDER.

(2)  THE ORDER SHALL BE FILED WITH THE CLERK OF THE
BOARD.

(C)  COMPENSATION AND REIMBURSEMENT FOR EXPENSES.
EACH MEMBER OF A BOARD IS ENTITLED TO:

(1)  COMPENSATION IN ACCORDANCE WITH THE STATE BUDGET
AT THE RATE OF $20 AN HOUR BUT NOT EXCEEDING $120 FOR EACH DAY OR
PART OF A DAY SPENT IN HEARING PROTESTS OR IN EXECUTIVE SESSION;
AND

(2)  REIMBURSEMENT FOR EXPENSES UNDER THE STANDARD
STATE TRAVEL REGULATIONS, AS PROVIDED IN THE STATE BUDGET.

(D)  STAFF.

WITH THE APPROVAL OF THE ADMINISTRATOR, EACH BOARD MAY
EMPLOY A STAFF IN ACCORDANCE WITH THE STATE BUDGET.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 81, §§
248(d) and 249.

In subsections (a) and (b)(1) of this section, the
phrase "two members of a board" is substituted for the
former references to "a majority" to clarify that at
least 2 regular members or 1 regular member and the
alternate member acting in the place of a regular
member are required for a quorum or to sign the order,
respectively.
