(C)  ENABLING ACT.

"ENABLING ACT" MEANS A LAW THAT AUTHORIZES A STATE UNIT TO
CREATE A DEBT AND TO SELL BONDS TO EVIDENCE THAT DEBT.

REVISOR'S NOTE: This subsection is new language added to
allow concise reference to the law that authorizes
issuance of bonds.

"State unit" § 8-201

(D)  RESOLUTION.

"RESOLUTION" MEANS A RESOLUTION OR OTHER EVIDENCE OF
OFFICIAL ACTION CUSTOMARILY USED BY A STATE UNIT.

REVISOR'S NOTE: This subsection is new language that
repeats a phrase in the first clause of the fourth
sentence of present Art. 31, § 12(a) and is restated
as a definition to allow concise reference to these
evidences of official action.

Defined term: "State unit" § 8-201

(E)  STATE UNIT.

(1)  "STATE UNIT" MEANS A UNIT OR INSTRUMENTALITY OF
THE STATE.

(2)  "STATE UNIT" DOES NOT INCLUDE THE STATE.

REVISOR'S NOTE: This subsection is new language that
combines, without substantive change, the following
provisions of Art. 31: (1) from § 9(a), the former
reference to any "instrumentality or agency of this
State" and the former exclusion "except that said term
shall not be construed to include this
State"; (2) from § 24(a), the former references to a
"department, commission, authority ... or other
instrumentality of the State" and "any State
agency"; (3) from § 29(a)(3), the former reference
to "any agency, department or instrumentality of the
State" and the former exclusion "[t]he term does not
include the State of Maryland"; and (4) from §
30(a)(4), the former reference to "a department,
commission, authority, ... agency or other
instrumentality of the State".

Although Art; 31, §§ 24(a) and 30(a)(4) formerly did
not expressly exclude the State, this exclusion was
implicit in light of other provisions.
