Subsection (b)(1) through (3), (5), and (6) of this
section is new language derived without substantive
change from former Art. 40, § 29(1), (4) through (6),
and all of (3) except for the phrase "on any subject
matter".
Subsection (b)(4) of this section combines, without
substantive change, the provisions on referrals to
other committees in former Art. 40, § 29(2) and, in
(3), the phrase "on any subject matter" and the second
clause of § 28(1). Thus, in subsection (b)(4) of this
section, the reference, in former Art. 40, § 29(2), to
referrals of "any recommended subject matter it
receives" is deleted as surplusage. Similarly, the
reference, in former Art. 40, § 28(1), to referrals of
matters "not otherwise undertaken for study ... by any
of these committees pursuant to § 27(e)(2) of this
subtitle" is deleted. These former references did not
appear to be limitations on the types of matters that
could be referred to the committees and, therefore,
were misleading.
Subsection (b)(7) of this section is new language
derived without substantive change from the second
sentence of former Art. 40, § 38.
In subsection (a)(5) of this section, the phrase "when
[the General Assembly] is not in session" is
substituted for the former reference "during the
interim between regular sessions", to conform to
similar references elsewhere in this title. The
substituted language reflects that the General
Assembly may meet in special session.
In subsection (a)(6) of this section, the former words
"other proposals" are deleted as unnecessary in light
of the broad reference to "recommendations".
In subsection (b)(1) of this section, the phrase "from
any source" is substituted for the former, specific
reference to "members of the Legislature ... and
individual citizens", for brevity.
In subsection (b)(6) of this section, the word
"resolution" is added to state expressly the power to
have resolutions drawn. This addition conforms to the
functions of the Committee under subsection (a)(6) of
this section.
In subsection (b)(7)(i) of this section, the defined
term "person" is substituted for the former phrase
"private department or agency", for clarity. As to
"person", see § 1-101 of this article and Art. 1, § 15
of the Code.
