(d)  An employee who has been included in the State merit
system under this [subsection] SECTION shall become a member of
the Employees' Retirement System of the State of Maryland with
service credit commencing on the date the employee is covered in
the State merit system. In the event the member's compensation is
paid wholly or partly from funds other than State funds, the
employer's cost of social security and retirement contributions
shall also be proportionately paid from the other funds.

(e)  Employees appointed effective July 1, 1978 pursuant to
[the subsection] THIS SECTION shall be given a January increment
date and shall receive their first increment on January 1, 1979.
Employees so appointed subsequent to July 1, 1978 shall receive
an increment as if the appointment date were the entry on duty
date.

39.

(A)  The facilities of the Secretary of Personnel shall be
available upon request to any municipality of this State adopting
the merit system of appointment of public employees, and to any
county of this State adopting such system either under the
Constitution of this State, Article XI-A and the Act of 1918,
Chapter 456, § 5-R or otherwise to the end that the merit system
may be administered in this State without unnecessary expense.

(B)  And said facilities shall also be available upon
request, to the judges of the several circuits of this State,
including the City of Baltimore, should such judges deem it
desirable to require the Secretary to provide for tests of the
fitness of candidates for deputy clerks before confirming their
appointment under the Constitution of this State, Article IV,
§[§] 26 [and 37]. Upon such requests being made to the Secretary
he shall assist in the promulgation of rules, the examination of
candidates for positions and otherwise extend the full use of his
facilities, without charge, to the officials making such request
except that in the case of the use of such facilities by any
municipality or county which causes the Secretary to incur
additional expenses for traveling or otherwise, then such
expenses shall be repaid to the Secretary by the officials in
whose interest such expenses were incurred.

Article 65 - Militia

8A.

All members of the Maryland National Guard, who are
designated by the Adjutant General of Maryland as National Guard
on-site technicians pursuant to the provisions of [32 U.S.C.A.
709] 32 U.S.C. § 709 and who are under the control or
jurisdiction of the Military Department, State of Maryland, and
who are acting in such capacity, are hereby invested, in and for
the military area to which assigned, with the same police power,
authority and status, with respect to criminal matters and the
enforcement of the law relating thereto, as sheriffs, constables,
