AN ACT concerning
St. Mary's County - Metropolitan Commission -
Rate Publication Requirement
FOR the purpose of requiring the St. Mary's County Metropolitan
Commission to promptly give notice in a certain manner of
all new rates, charges, or assessments to be levied by it;
and correcting an obsolete reference.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 19 - St. Mary's County
113-27.
D. Transition. In the event that the St. Mary's County
Metropolitan Commission has decided to exercise powers granted by
§ 427a of Article 43 § 9-727 OF THE HEALTH - ENVIRONMENTAL
ARTICLE of the Annotated Code of Maryland, the Commission may
nevertheless exercise any and all powers granted by this chapter
on and after June 1, 1976, without any further action on the part
of the Commission except those actions required by this chapter.
In the event that the Commission decides that any modification of
an existing rate, charge or assessment previously established by
it is necessary or [desirable,] DESIRABLE OR THAT THE CREATION OF
A NEW RATE, CHARGE OR ASSESSMENT IS NECESSARY OR DESIRABLE, the
Commission shall promptly give notice of the proposed rates,
charges and assessments in at least one (1) newspaper of general
circulation in St. Mary's County. The Commission shall
thereafter conduct a public hearing on the necessity or
advisability of the proposed rates, charges or assessments. If
the Commission acquires an existing water or sewer system, either
public or private, the rates, charges or assessments to be
imposed by the Commission on the persons served by the acquired
system shall be treated as the establishment of a rate, charge or
assessment within the meaning of this section.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.
