AN ACT concerning

Reimbursement to Local Jurisdictions Housing
State Prisoners

FOR the purpose of providing that the reimbursement formula for
housing State prisoners in local facilities be based on the
total actual annual operating costs of the local
jurisdiction; and making a technical change.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

690.

(g) (1) When formulating an agreement for reimbursement of
a county or Baltimore City for the confinement of prisoners in
local facilities who have been sentenced to the jurisdiction of
the Division of Correction, the Division shall [include the total
annual operating budget of that local facility divided by the
total actual prisoner days for the previous fiscal year and used
to compute the total annual operating budget for the previous
fiscal year of the facility] USE THE TOTAL ACTUAL ANNUAL
OPERATING COSTS OF THAT LOCAL FACILITY FOR THE PREVIOUS FISCAL
YEAR DIVIDED BY THE TOTAL ACTUAL PRISONER DAYS OF THE FACILITY
FOR THE PREVIOUS FISCAL YEAR.

(2) The total annual ACTUAL operating [budget
includes] COSTS INCLUDE all costs directly associated with or
directly attributable to the operation of the facility.

(3) The total ACTUAL annual operating [budget does]
COSTS DO not include:

(i) Overhead costs allocated from other
agencies or institutions;
