(V) EACH COUNTY'S UNADJUSTED SET-ASIDE FOR
VOCATIONAL-TECHNICAL EDUCATION AS DERIVED IN (III) IS MULTIPLIED
BY THE ADJUSTMENT FACTOR DERIVED IN (IV). THE RESULTING PRODUCT
IS THE SET-ASIDE FROM BASIC CURRENT EXPENSE AID FOR
VOCATIONAL-TECHNICAL EDUCATION FOR THE COUNTY.
5-205.
(A) After notification from the State Superintendent that a
county is not complying with the provisions of the State program
of public education OR THE MAINTENANCE OF LOCAL EFFORT PROVISIONS
OF SECTION 5-2-202 OF THIS ARTICLE OR A COUNTY FAILS TO SUBMIT
REPORTS REQUIRED BY MEET THE REQUIREMENTS OF SUBTITLE 4 OF TITLE
5 OF THIS ARTICLE, the State Comptroller shall withhold any
installment OR PORTION THEREOF AS DIRECTED BY THE STATE
SUPERINTENDENT due the county from the General State School Fund.
(B) (1) IF THE SUPERINTENDENT FINDS THAT A COUNTY IS NOT
COMPLYING WITH THE MAINTENANCE OF LOCAL EFFORT PROVISIONS OF §
5-202 OF THIS ARTICLE OR THAT A COUNTY FAILS TO MEET THE
REQUIREMENTS OF TITLE 5, SUBTITLE 4 OF THIS ARTICLE, THE
SUPERINTENDENT SHALL NOTIFY THE COUNTY OF SUCH NONCOMPLIANCE.
(2) IF A COUNTY DISPUTES THE FINDING WITHIN 30 DAYS
OF THE ISSUANCE OF SUCH NOTICE, THE DISPUTE SHALL BE PROMPTLY
REFERRED TO THE STATE BOARD OF EDUCATION WHICH SHALL MAKE A FINAL
DETERMINATION.
(3) UPON RECEIPT OF CERTIFICATION ON NONCOMPLIANCE BY
THE SUPERINTENDENT OR THE STATE BOARD, AS THE CASE MAY BE, THE
COMPTROLLER SHALL WITHHOLD SUSPEND, UNTIL NOTIFICATION OF
COMPLIANCE IS RECEIVED, PAYMENT OF ANY FUNDS DUE THE COUNTY FOR
THE CURRENT FISCAL YEAR, AS PROVIDED UNDER § 5-202 OF THIS
ARTICLE WHICH ARE APPROPRIATED IN THE GENERAL STATE SCHOOL FUND,
TO THE EXTENT THAT THE STATE'S AID DUE THE COUNTY IN THE CURRENT
FISCAL YEAR UNDER THAT SECTION IN THE FUND EXCEEDS THE AMOUNT
WHICH THE COUNTY RECEIVED IN THE PRIOR FISCAL YEAR.
SUBTITLE 4. ACCOUNTABILITY ADVISORY TASK FORCE
5-401.
(A) (1) IT IS STATE POLICY THAT LOCAL GOVERNMENTS
EDUCATIONAL AGENCIES SHOULD ENSURE THAT ADDITIONAL STATE
EDUCATION AID RESULTS IN DEMONSTRATED IMPROVEMENTS IN THE QUALITY
OF CLASSROOM EDUCATIONAL SERVICES CLASSROOM INSTRUCTION AND
STUDENT PERFORMANCE.
(2) IN ORDER TO EFFECT DEMONSTRATED IMPROVEMENTS IN
CLASSROOM INSTRUCTION AND STUDENT PERFORMANCE, IT IS ALSO STATE
POLICY THAT EXPENDITURE OF INCREASES IN STATE PUBLIC EDUCATION
AID IN BASIC CURRENT EXPENSE, AS PROVIDED UNDER SECTION 5-202(B),
AND IN COMPENSATORY EDUCATION FUNDS, AS PROVIDED UNDER SECTION
5-202(E), SHALL BE LIMITED TO THE FOLLOWING CLASSIFICATIONS:
