SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - State Government
2-505.
(a) A majority of the full authorized membership of the
committee is a quorum.
(b) The Department of Legislative Reference shall provide
staff assistance WITH PRIMARY RESPONSIBILITY to the committee.
10-111.1.
(A) DURING THE 45-DAY REVIEW PERIOD, UNDER SUBSECTION (A)
OF § 10-111 OF THIS ARTICLE, THE COMMITTEE SHALL REVIEW THE
PROPOSED REGULATION AND RECOMMEND STANDING COMMITTEE REFERRALS TO
THE APPROPRIATE HOUSE AND SENATE STANDING COMMITTEES FOR THEIR
FULL CONSIDERATION.
(B) PURSUANT TO THIS SECTION THE ASSIGNED STANDING
COMMITTEES MAY CONDUCT JOINT OR INDEPENDENT HEARINGS AS NECESSARY
WITHIN THE 45-DAY REVIEW PERIOD TO MAKE A RECOMMENDATION AND
REACH A JUDGMENT AS TO:
(1) THE NECESSITY AND REASONABLENESS OF THE PROPOSED
REGULATION;
(2) THE AUTHORITY OF THE PROMULGATING UNIT TO PROPOSE
THE REGULATION; AND
(3) THE INTENT OF THE LEGISLATURE IN DELEGATING ITS
RESPONSIBILITIES TO PROPOSE THE REGULATION.
(C)(1) THE PROPOSED REGULATION OR ANY PORTION OF THE
REGULATION MAY BE RECOMMENDED FOR SUSPENSION BY A MAJORITY OF THE
VOTING MEMBERS OF EITHER OF THE ASSIGNED STANDING COMMITTEES IF
EITHER STANDING COMMITTEE FINDS THE PROPOSED REGULATION OR ANY
