VETOES

FOR the purpose of making certain employees who are involved in
the training or racing of a racehorse for the purposes of
the Workmen's Compensation Article, employees of the owner
of the racehorse; and generally relating to workmen's
compensation.

BY adding to

Article 101 - Workmen's Compensation

Section 21(b)(12) and (13)

Annotated Code of Maryland

(1979 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 101 - Workmen's Compensation

21.

(b) The following shall constitute employees subject to the
provisions of this act, except as exempted under subsection (c)
of this section:

(12)  (I) ANY INDIVIDUAL PERFORMING SERVICES AS AN
EXERCISE BOY OR GIRL, GROOM, OR HOT-WALKER IN CONNECTION WITH THE
TRAINING OR RACING OF A THOROUGHBRED RACEHORSE AT A TRACK
LICENSED BY OR A TRAINING CENTER RECOGNIZED BY THE MARYLAND
RACING COMMISSION.

(II) SOLELY FOR THE PURPOSES OF THIS ACT, AN
EXERCISE BOY OR GIRL, GROOM, OR HOT-WALKER SHALL BE DEEMED TO BE
A NONCASUAL EMPLOYEE OF THE OWNER OF THE HORSE ON OR FOR WHICH HE
OR SHE WAS PERFORMING SERVICES AT THE TIME OF THE INJURY. THE
EMPLOYEE'S AVERAGE WEEKLY WAGE SHALL BE DEEMED TO BE THE TOTAL
AVERAGE WEEKLY WAGE FOR ALL EMPLOYERS FOR WHOM THE EMPLOYEE
PROVIDED SERVICES AS ENUMERATED IN PARAGRAPHS (12) AND (13) OF
THIS SUBSECTION.

(13)(I) ANY JOCKEY RACING A RACEHORSE IN A SCHEDULED
RACE AT A TRACK LICENSED BY THE MARYLAND RACING COMMISSION SHALL
FOR THE PURPOSES OF THIS ACT BE DEEMED A NONCASUAL EMPLOYEE OF
THE OWNER OF THE HORSE ON OR FOR WHICH HE OR SHE WAS PERFORMING
SERVICES AT THE TIME OF THE INJURY. PERFORMING SERVICES IN
CONNECTION WITH THE RIDING OF A THOROUGHBRED RACE HORSE AT A
TRACK LICENSED BY OR AT A TRAINING CENTER RECOGNIZED BY THE
MARYLAND RACING COMMISSION.

(II) SOLELY FOR THE PURPOSES OF THIS ACT, A
JOCKEY SHALL BE DEEMED TO BE THE NONCASUAL EMPLOYEE OF THE OWNER
OF THE HORSE ON OR FOR WHICH HE OR SHE WAS PERFORMING SERVICES AT
THE TIME OF THE INJURY. THE EMPLOYEE'S AVERAGE WEEKLY WAGE SHALL
