Dear Mr. Speaker:

In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed House Bill 865.

This bill provides that the tax on packs of cigarettes
containing more than 20 cigarettes each shall be 6-1/2 cents for
each 10 cigarettes and 6-1/2 mills per cigarette on each
cigarette in excess of 20 per pack.

Senate Bill 346, which was passed by the General Assembly
and signed by me on May 29, 1984, accomplishes the same purpose.
Therefore, it is not necessary for me to sign House Bill 865.

AN ACT concerning

State Tobacco Tax - Rate of Tax

FOR the purpose of providing that the existing tax rate of 6 1/2
cents per 10 cigarettes or fractional part thereof applies
when the cigarettes are in packs containing 20 or fewer
cigarettes; providing that on packs of cigarettes containing
more than 20 cigarettes each, the first 20 cigarettes shall
be taxed at the existing rate and that the tax on each
cigarette in excess of 20 cigarettes shall be a certain
rate; providing for a delayed effective date; and generally
relating to the State tobacco tax.
