Cemetery Desecration
FOR the purpose of altering the penalties for certain crimes
relating to cemetery desecration; permitting a court to
order a judgment of restitution against a parent or parents
of juvenile offenders under certain circumstances;
permitting a court to order a child to make restitution
under certain circumstances; and altering the penalties for
desecrating a cemetery and generally relating to desecrating
a cemetery.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 27 - Crimes and Punishments
267.
(A) Any person or persons, or his, her, or their aiders or
abettors, who shall wilfully destroy, mutilate, deface, injure or
remove WHO WILLFULLY DESTROYS, MUTILATES, DEFACES, INJURES, OR
REMOVES any tomb, monument, gravestone or other structure placed
in any cemetery, or any building, wall, fence, railing or other
work, for the use, protection or ornamentation of any public or
private cemetery in this State [or] SHALL BE IS GUILTY OF A
MISDEMEANOR AND SHALL ON CONVICTION:
(1) (I) PAY THE CEMETERY THE VALUE OF THE PROPERTY
DAMAGED; OR
(II) RESTORE THE PROPERTY TAKEN TO THE CEMETERY
OR PAY THE CEMETERY THE VALUE OF THAT PROPERTY; AND
(2) BE FINED NOT MORE THAN $1,000 $2,000, OR
IMPRISONED FOR NOT MORE THAN 5 3 YEARS, OR BOTH.
(B) ANY PERSON OR PERSONS, OR HIS, HER, OR THEIR AIDERS OR
ABETTORS WHO shall wilfully destroy, cut, break, or remove WHO
